Speeding Fines N.J.S.A. 39:4-98, Paterson, NJ Traffic Violation Lawyers

In New Jersey, traffic violations fall under Title 39 of the New Jersey Statues Annotated. Speeding violations are found in section N.J.S.A. 39:4-98 which details the penalties for excessive speed.

  • Speeding which exceeds the legal limit by 1-9 miles per hour – $81 fine
  • Speeding which exceeds the legal limit by 10-14 miles per hour – $91 fine
  • Speeding which exceeds the legal limit by 15-19 miles per hour – $176 fine
  • Speeding which exceeds the legal limit by 20-24 miles per hour – $196 fine
  • Speeding which exceeds the legal limit by 25-29 miles per hour – $216 fine
  • Speeding which exceeds the legal limit by 30-34 miles per hour – $236 fine
  • Speeding which exceeds the legal limit by 35-39 miles per hour – $256 fine
  • Safe Corridor or Construction Zone speeding which exceeds the legal limit by 1-9 miles per hour – $136 fine
  • Safe Corridor, Construction Zone or 65 M.P.H. zone speeding which exceeds the legal limit by 10-14 miles per hour – $156 fine
  • Safe Corridor, Construction Zone or 65 M.P.H. zone speeding which exceeds the legal limit by 15-19 miles per hour – $176 fine

All fines are doubled for any driver exceeding the speed limit by 20 m.p.h. or greater, which is bolded above. If you have exceeded the speed limit by 40 miles per hour or greater, you are legally obligated to appear in court. Similarly, if you have exceeded the speed limit by 20 miles per hour or more in a Safe Corridor or Construction Zone, you are required to appear in court.

Passaic County, NJ Speed Limit Violation Lawyers Discuss Driver’s License Points

In addition to the fines above, violations may result in up to 5 points towards your diver’s license or even a suspension. Drivers will be penalized 2 points for speeding between 1-14 m.p.h. over the limit, 4 points for speeding 14-29 m.p.h. over the limit, and 5 points for 30 m.p.h. or greater over the limit. If a driver accrues more than 6 points in a three year period, he or she will also be charged $150 plus an additional $25 for each point over 6. Failure to pay fines or these additional surcharges may result in a suspended or lost license.

The Motor Vehicle Commission may put an administrative suspension on your driver’s license if you accrue 10 or more points. If you have accumulated 12 or more points within a two year period or 15 or more points over any amount of time, your license will be suspended for a minimum of 30 days or revoked outright. Another downside of points on a driver’s license is that auto insurance providers may take your accumulated points into account when determining your insurance rates.
